General Conditions of Sale (GCS)
Article 1: Preamble and Legal Information These General Terms and Conditions of Sale (GCS) apply without restriction or reservation to all sales concluded by woqpow, a brand of the company PEJMAN, a sole proprietorship (EI), whose registered office is located at 56 Avenue des Dragons de l'Impératrice, 33127 Martignas-sur-Jalle, France. PEJMAN is registered under SIRET number 804 246 916 00022 (RCS Bordeaux). Consequently, VAT is not applicable on invoices issued. In accordance with Article 293 B of the CGI, our prices are displayed as tax-free. These GCS govern the contractual relationship between woqpow and any consumer, a major natural person not acting for professional purposes (hereinafter the "Client"), making a purchase on the website https://woqpow.com (hereinafter the "Site"). Any order placed on the Site implies the Client's prior and unreserved acceptance of these GCS. woqpow reserves the right to modify these GCS at any time. The applicable GCS are those in force on the date of the Client's order.
Article 2: Products woqpow offers interactive and educational robots inspired by our woqpow collection for sale. The main characteristics of the products are presented on the Site for each product page. The photographs and descriptions of the products are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors or slight variations in appearance due to manufacturing. The availability of products is clearly indicated on the Site. In the event of a product's unavailability after an order is placed, the Client will be informed by email as soon as possible. The order will be automatically canceled and the Client will be refunded the amount of the unavailable product, as well as the associated delivery costs, as soon as possible.
Article 3: Prices The prices of the products are indicated in Euros (€) and are displayed excluding delivery fees. In accordance with Article 293 B of the French General Tax Code, VAT is not applicable to our prices. Delivery fees are free for all orders. woqpow reserves the right to modify its prices at any time, but the price invoiced to the Client will be the one in effect at the time the order is validated.
Article 4: Order Placing an order on the Site follows these steps: Selection of the product(s) and addition to the cart. Cart validation. Client identification (existing account) or creation of an account. Entry of delivery and billing information. Choice of payment method. Review of the order summary and express acceptance of these GCS (by checking a box). Payment validation. The order will be considered final only after woqpow has received the full price and sent the Client an order confirmation by email.
Article 5: Payment Payment is made online only by credit card (Visa, MasterCard, American Express). Transactions are fully secured through the SSL encryption system. woqpow does not have access to the Client's payment details, as this information is processed directly by our secure payment provider. The credit card is debited at the time the order is validated.
Article 6: Delivery Products are delivered to the address indicated by the Client during the order. The estimated delivery times vary depending on the geographical destination zone: For orders to the United States, the estimated delivery time is 4 to 8 business days from the date of order shipment. For orders to the European Union, the estimated delivery time is 15 to 20 business days from the date of order shipment. The total delivery time includes order processing and transit. A tracking number will be sent to the Client by email as soon as the order has been processed and shipped, allowing them to track the package's progress in real time. woqpow cannot be held responsible for delivery delays due to force majeure or unpredictable and insurmountable events (such as carrier strikes, exceptional weather, natural disasters, etc.). In the event of non-receipt of the order within the indicated timeframe, the Client is invited to contact woqpow customer service. If the investigation conducted by the carrier confirms the loss of the package, woqpow commits to shipping a new product to the Client (subject to availability) or to issuing a full refund for the order if the product is no longer available.
Article 7: Right of Withdrawal and Returns In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Client has a right of withdrawal of fourteen (14) calendar days from the date of receipt of the product, without having to provide any reasons or pay penalties. Article 8: Legal Guarantees All products sold by woqpow benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Legal warranty of conformity: woqpow is required to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. The Client can act within a period of two years from the delivery of the goods. In the event of a lack of conformity, the Client can choose between repair or replacement of the goods, or if these options are impossible, a price reduction or termination of the contract. Warranty against hidden defects: woqpow is liable for hidden defects in the goods sold that make them unfit for the use for which they were intended, or that so diminish this use that the buyer would not have acquired them, or would have paid a lower price for them, had they known of the defects. Article 9: Liability woqpow cannot be held responsible for the inconveniences or damages inherent in the use of the Internet, particularly a service interruption, an external intrusion, the presence of computer viruses, or any event qualified as force majeure.
Article 10: Personal Data The personal information and data concerning the Client are necessary for order management, product delivery, and the commercial relationship. They may be transmitted to companies that contribute to these relationships, such as those charged with the execution of services and orders (carriers, payment platforms) for their management, execution, processing, and payment. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR) no. 2016/679 of April 27, 2016, the Client has a right of access, rectification, erasure, opposition, restriction, and data portability concerning them. Article 11: Intellectual Property All elements of the Site (texts, product images, logos, trademarks, databases, etc.) are the exclusive property of woqpow or its partners and are protected by copyright, trademark law, and any other intellectual property right. Any reproduction, exploitation, redistribution, or use of any kind, even partially, of the elements of the Site and in particular of the products presented, is strictly prohibited without the prior written consent of woqpow.
Article 12: Applicable Law - Disputes - Mediation These GCS are subject to French law. In the event of a dispute, the parties will endeavor to find an amicable solution. In accordance with Articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute that could not be resolved amicably, the Client has the option of resorting free of charge to a consumer mediator.
